The Law Society Finuas Skillnet (the Network) believes that sufficient justification exists to award this contract under negotiated procedure without prior call for competition, in line with provisions of 32.2(b)(ii) for the reasons set out below. The Network provides 84 course modules for 30 000 users across ten Learning Management Systems currently hosted with Learn Skills the incumbent service provider. The Network uses subdomains for the ten Learning Management Systems, but the main domain belongs to Learn Skills. A new service provider would not be able to use the same domain name and would need to transfer the programme and user data to a different domain. Such transition would require input from and coordination between the incumbent and the new supplier and would be particularly labour intensive in respect of learning management system code evaluation and course source projects evaluation (120 Camtasia projects and 33 Captivate projects, each between 1-2GB in size). Overall, the estimated cost of transition is just above EUR 115 000 which represents 38 % of the overall estimated contract value over the 3-year term. The need for transition and the associated cost are not artificial the competition without the transition is not possible. The Network is satisfied, however, that paying nearly 40 % of the overall contract value for transition does not constitute a reasonable alternative or substitute. As such, the Network is satisfied that a competition for this contract cannot be held for technical reasons. Furthermore, the Network is satisfied that no reasonable alternative or substitute exists, and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement. Accordingly, the Network intends to award the contract under negotiated procedure without prior call for competition, in line with provisions of Article 32.2(b)(ii).
