The events that have led to the need for extreme urgency were unforeseeable and could not have been predicted by a reasonable diligent authority. The present situation is not attributable to the contracting authority in any way and with council staff employed in other capacities it is not possible to comply with the usual timescales in the 2015 Regulations. There is also no known available framework whereby a call off contract under an existing commercial agreement such as a framework or dynamic purchasing system could be undertaken. The Council therefore perceive that the extreme urgency factors within Section 33 of the Public Contracts (Scotland) Regulations 2015 have been met and with a duty to ensure that there is service provision for vulnerable persons, it is proposed that a direct award is made for a period of seven months as the full impact of Covid-19 is unknown in terms of both our own workforce and that of service providers. This will allow time for tendering activity to re-commence.
