Procurement will be carried out in accordance with the EBRD Procurement Policies and Rules (PPR), which are published on the Banks website. Municipal institution (legal form under Tajik legislation) Housing and Municipal Production and Operational Department of Yavan City (in Tajik PAAT ), which was established by Yavan District on 20.2.1997, Tax ID. No 400000781, hereinafter referred to as the Employer or the Client, has received a loan from the European Bank for Reconstruction and Development, hereinafter referred to as the Bank and intends using part of the proceeds towards the cost of Yavan Solid Waste Project, hereinafter referred to as the Project. The client now invites tenders for the following contract(s), hereinafter referred to as the Contract, to be funded from part of the above proceeds: YSWP02 Reconstruction of Central Depot. Tendering for contracts to be financed with the above proceeds is open to firms and individuals from any country. To be qualified for the award of a Contract, tenderers must substantially satisfy the following minimum criteria: (a) average annual turnover The tenderer must demonstrate minimum average annual construction turnover of 300 000,00 USD (Three hundred thousand USD), calculated as total certified payments received for Contracts in progress or completed, within the last 3 [2016, 2017, 2018] years. The lead partner of a JVCA shall meet 70 % of this requirement. Each other partner shall meet not less than 30 % of this requirement. (b) experience Experience in the role of contractor, in at least 2 contracts within the last 5 years, each with a value of at least 90 000,00 USD (ninety thousand), that have been successfully and substantially completed and that are similar to the proposed works. The similarity shall be based on the nature and complexity of the works compared with the works described in Section V) Requirements. The lead partner of a JVCA shall demonstrate successful experience in at least 1 contract of similar nature and magnitude. (c) historical contract non-performance The tenderer, or any partner in a JVCA, shall not have a consistent history of litigation and/or arbitration resulting in awards against the tenderer, or any partner in a JVCA, within the last 3 years, namely 2016-2018. This determination shall be based solely on fully settled disputes or litigation. A fully settled dispute or litigation is 1 that has been resolved in accordance with the dispute resolution mechanism under the respective Contract and where all appeal instances available to the tenderer have been exhausted. All pending litigation shall in total not represent more than twenty percent (20 %) of the tenderers net worth and shall be treated as resolved against the tenderer. The tender document, upon request, will be dispatched electronically free of charge. All tenders must be accompanied by a tender security of 4 000 USD (four thousand US dollars) or its equivalent in TJS or freely convertible currency.
