WORKS PROCUREMENT NOTICE
Republic of Montenegro
Local open tender
1. This invitation for Tenders follows the General Procurement Notice
for this project which was published in OJCE on 08/11/2002 Number 2002 /
The Government of Montenegro has received a loan from the European
Investment Bank "EIB", towards the cost of a Railways Rehabilitation
Project, and it intends to apply of the proceeds of this loan to payments
under the contract(s) for the works of:
Rehabilitation of Tunnel N. 161 Km 316+904.74 - Km 320+151
Rehabilitation of Tunnel N. 172 Km 331+958.76 - Km 332+226.76
- In Two (2) lots.
The Contracting Authority is the Railway of Montenegro: Zeljeznica Crne
Gore a.d. - Podgorica (Montenegro).
The rehabilitation concept shall first mean considering the tunnel lining
to be the rock of certain quality compliant with NATM principles. This
means that the tunnel tube and the surrounding rock shall be strengthened
by rock-adhesive anchors to increase the ultimate stress resistance of
the newly formed assembly. The lining area assessed to be in the worst
condition shall be replaced with new concrete of adequate
characteristics. This lining, acting as a strong membrane composite with
anchors, shall prevent expansion of the surrounding mass in the direction
of the tunnel opening. The gap between the lining and the rock shall be
grouted. In addition, the good contact made between the rock and lining
and penetration of grout in the system of cracks in the rocks and lining
shall decrease the system deformability and reduce the possibility of
water infiltrating through the structure.
2. Eligibility and rule of origin Participation is open on equal terms
to all natural and legal persons [participating either individually or in
a grouping (consortium) of tenderers] of any country of the world unless
otherwise specified in the Tender documents.
3. Grounds for exclusion Persons or entities or any import of goods, if
payment or import is prohibited by a decision of the United Nations
Security Council taken under Chapter VII of the Charter of the United
4. Number of tenders Tenderers (including firms within the same legal
group, other members of the same consortium, and subcontractors) may
submit only one tender for one lot or more lots. Tenders for parts of a
lot will not be considered. Any tenderer may state in its tender that it
would offer a discount in the event that its tender is accepted for more
than one lot. Tenderers may not submit a tender for a variant solution in
addition to their tender for the works required in the tender dossier.
5. Tender guarantee Tenderers must provide a tender guarantee of
16,000.- Euro for lot 1 and/or of 7.000.- Euro for lot 2 in euro when
submitting a tender. This guarantee will be released to unsuccessful
tenderers once the tender procedure has been completed and to the
successful tenderer(s) upon signature of the contract by all parties.
This guarantee will be called upon if the tenderer does not fulfil all
obligations stated in its tender.
6. Performance guarantee The successful tenderer will be asked to
provide a performance guarantee of 10% of the contract value in euro when
countersigning the contract. This guarantee must be provided no later
than 30 days after the tenderer receives the contract signed by the
Contracting Authority. If the selected tenderer fails to provide such a
guarantee within this period, the contract will be void and a new
contract may be drawn up and sent to the tenderer which has submitted the
second best admissible tender.

8. Tender validity Tenders must remain valid for a period of 90 days
after the deadline for submission of tenders.
9. Period of execution The period of execution shall be 12 months for
lot 1 - Tunnel N. 161 and 10 months for lot 2 - Tunnel N. 172, from the
date of the commencement of the works.
10. Selection criteria The capacity of tenderers to execute the
specified works shall be established by providing documented evidence of
economic and financial standing, professional capacity, and technical
capacity; with the minimum selection criteria as follows: a) Annual
turnover in the past 3 years at least Euro 2 million, b) Credit
availability at least Euro 200.000. c) Experience in 3 similar contracts
during previous 5 years, d) Key personnel with at least 5 years"
experience and qualifications to similar works, e) For a Joint Venture,
leading partner capable of undertaking at least 50% of the works, other
partner(s) at least 10%, f) adequate equipment to complete the works
satisfactorily; g) Relevant works plan and programme; And others as
specified in the tender dossier.

Tenders must be submitted using the standard tender form included in the
tender dossier, whose format and instructions must be strictly observed.
Tenderers with questions regarding this tender should send them in
writing to the Contracting Authority quoting the publication reference,
at least 21 days before the deadline for submission of tenders. The
Contracting Authority must reply to all tenderers" questions at least 11
days before the deadline for submission of tenders.
13. Deadline for submission of tenders The deadline for submission of
tenders is 19th Ocober 2004 at 12:00 (Podgorica local time).
Any tender received after this deadline, as well as uncompleted tenders,
will not be considered.
